PURPOSE: Delivery of money or in-kind goods as a FREE, VOLUNTARY, AND IRREVOCABLE DONATION.
Legal Framework of the Donation
1- Civil Code and Exception of Insinuation (Judicial Authorization)
The donation is governed by the Colombian Civil Code (Art. 1443 et seq.).
I. Low-Value Donations (General Web Rule):
Given that online donations are usually for small amounts, they do not require notarial authorization (public deed), provided the value does not exceed 50 Current Monthly Legal Minimum Wages (SMMLV), in accordance with Article 1458 of the Civil Code.
II. High-Value Donations (Exception):
If the donation (in money or in-kind) exceeds the 50 SMMLV threshold, the Donor commits to notifying Viajar Libremente S.A.S. and fulfilling the notarial authorization formality required by law for its full validity and effectiveness.
2. Electronic Validity.
The present donation is considered a valid legal act with full effect in the digital environment, supported by Law 527 of 1999 (Electronic Commerce Law), where consent is granted through the electronic payment action.
3. Donor Declarations and Acceptance
By clicking the “Donate” or “Confirm Payment” button on the website, and completing the transaction, the Donor declares and accepts the following:
- Voluntariness and Gratuity: The donation is an act of mere liberality; the Donor neither expects nor demands any consideration or direct benefit from Viajar Libremente S.A.S.
- Legality of Funds: The Donor is the legitimate owner of the funds, and they come from lawful activities, exempting Viajar Libremente S.A.S. from any liability in this regard.
- Irrevocability: The act of donation is irrevocable once accepted and the payment is completed, except in cases expressly provided by Colombian law.
- Use of Funds: The funds will be allocated to the corporate purpose of Viajar Libremente S.A.S. The Donee is not obliged to provide detailed accountability on the final use of the individual donation.
4. Tax Implications and Certification
- Tax Benefit (Tax Discount): If the Donor is a taxpayer of the Income Tax in Colombia, they may access the tax discount of 25% of the donated value (Art. 257 E.T. – Tax Statute).
- Issuance of the Certificate: To access this benefit, the Donor must provide their Full Name, ID (Cédula) or NIT, and Address at the time of the donation. Viajar Libremente S.A.S. will issue the corresponding certificate only if it meets the legal requirements to be a recipient of deductible donations.
- Required Information: If the Donor does not provide their complete identification information, the donation will be considered anonymous for tax purposes, and the Donation Certificate will not be issued.
5. Personal Data Protection (Habeas Data)
he Donor authorizes Viajar Libremente S.A.S. to collect, store, and process their personal data for the following purposes: (i) Processing the donation, (ii) Issuing the Donation Certificate (if applicable), (iii) Complying with reports required by the DIAN (Tax Authority) and other control authorities, and (iv) Sending periodic information on the use of the funds.
